Our Intellectual Property

User Content

Project Deliverables

Upon full payment for our services, and unless otherwise specified in a separate agreement:

• For custom design projects, we transfer to you ownership of the final deliverables as specified in the project agreement
• We retain ownership of all preliminary concepts, drafts, and unused designs
• We retain the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about design

DMCA Compliance

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our copyright agent with the following information in writing:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest
• A description of the copyrighted work that you claim has been infringed
• A description of where the material that you claim is infringing is located on the Service
• Your address, telephone number, and email address
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be primarily settled through amicable negotiations between you and G4SkinCS.

If such dispute cannot be settled amicably, it shall be finally settled by arbitration in accordance with the rules of the London Court of International Arbitration. The arbitration shall take place in London, United Kingdom, in the English language, and the arbitral decision may be enforced in any court.

Class Action Waiver

Any arbitration or court trial (whether before a judge or jury) shall be on an individual basis only. Class actions and class arbitrations are not permitted. Neither you nor we may act as a private attorney-general in court or in arbitration or join or consolidate claims with claims of any other person or entity.

Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
